Plain-English Promise

We collect data from both Creators and Fans to run the marketplace, keep it safe, and unlock new opportunities (including brand deals and collaborations). We do not sell your personal info for cash. Where the law treats certain sharing for ads or audience matching as a "sale" or "share," you can opt out. We'll use data to benefit creators, grow fandoms, and protect the community—while honoring your legal rights.

These practices describe how FanVault, Inc. ("FanVault," "we," "us") collects, uses, discloses, and protects information when you use our websites, apps, and related services (collectively, the "Service"). Capitalized terms not defined here have the meanings in our Terms of Service.

1. Scope & Eligibility

This Policy applies to the Service globally. The Service is for adults (18+). We may use age and identity verification (including government ID) for eligibility, compliance, payouts, risk, and safety.

2. Information We Collect

We collect information directly from you, automatically from your devices, and from third parties.

A. Information You Provide

  • Account & Profile: name, display name, email, phone, handle, bio, avatar, preferences.
  • Creator Business Details: legal name, business name, EIN, address, tax forms, payout preferences, storefront settings, shipping preferences.
  • Identity & KYC/KYB: date of birth, address, government-issued ID, selfie/biometric checks (where required by payment/KYC partners), sanctions screening outcomes.
  • Payments & Payouts: we use payment partners (e.g., Stripe Connect) to collect banking and card data (account and routing numbers, last-4, card tokens, bank verification, chargeback data). We generally do not store full raw bank or card numbers on FanVault systems but may receive tokens, status, outcomes, and the last 4 digits.
  • Listings & Content: titles, descriptions, pricing, photos/videos, category, item condition, inventory. We may process content to enforce brand-safe rules and community safety.
  • Communications: messages with other users; messages with Support; survey responses; referral program info.
  • Shipping & Fulfillment: shipping addresses, delivery preferences, customs data where applicable.
  • Creator Opportunities: brand program applications; pitch decks; samples; demographics and audience insights you choose to share; permissions for introductions.

B. Information We Collect Automatically

  • Device & Log: IP address, device identifiers, OS/browser, app version, language, time zone, crash logs, performance, diagnostic and telemetry data.
  • Usage & Events: pages viewed, clicks, features used, session duration, referring/exit pages, search queries, auctions and checkout actions.
  • Location: approximate location derived from IP or device settings.
  • Cookies/SDKs/Pixels: to authenticate, remember preferences, measure performance, fight fraud/abuse, and (where enabled) for analytics and advertising. See §8.

C. Information from Third Parties

  • Payments/Banking & KYC Vendors: identity verification results, risk signals, payout status, chargeback/ACH return details.
  • Shipping/Carriers: tracking events, delivery confirmations, claims outcomes.
  • Brand & Retail Partners: campaign requirements, audience criteria, performance metrics for deals you participate in.
  • Marketing/Ad Partners & Data Enrichment: hashed identifiers, interest segments, lookalike audiences, campaign performance.
  • Public/Community Sources: publicly available profiles, posts, or feedback that reference your Storefront; anti-fraud and trust databases.

3. How We Use Information (Purposes)

We use information for the following business and commercial purposes:

  • Operate the Service – account creation, authentication, payouts, payments, shipping, notifications.
  • Transactions – facilitate auctions and sales, collect fees, prevent non-payment, manage chargebacks/returns exceptions.
  • Safety & Compliance – age/identity/KYC, moderation (brand-safe listings; no nudity/graphic/explicit language), fraud prevention, security, legal compliance, sanctions screening.
  • Opportunities for Creators – audience analytics, brand-deal matching, marketplace recommendations, and cross-network introductions. This may include sharing Creator storefront metrics and contact information with potential brand partners where legally permitted or with your consent.
  • Recommendations & Personalization – ranking, search, discovery, and notifications tailored to your activity.
  • Analytics & Product Improvement – usage analytics, A/B tests, bug fixes, quality assurance. We may use de-identified or aggregated data to develop and improve features, including moderation systems and recommendation models.
  • Marketing & Growth – service announcements, lifecycle emails, creator acquisition, audience growth, referral programs; where required, we obtain consent or provide opt-outs.
  • Advertising & Audience Matching (Optional / Jurisdiction-Dependent) – limited sharing of identifiers or hashed contact data with platforms to measure or improve ads for FanVault or creator campaigns. Where laws treat this as a "sale" or "share," you may opt out (see §9).
  • Enforcement & Defense – enforce Terms, investigate violations, and defend against claims.

We may combine information across sources for these purposes.

4. Legal Bases (EEA/UK/Similar Jurisdictions)

Where required, we rely on: (a) contract (to provide the Service), (b) legitimate interests (safety, fraud prevention, analytics, creator opportunities), (c) consent (certain marketing/ads or sensitive data uses), and (d) legal obligations (tax, KYC, sanctions, bookkeeping).

5. How We Share Information

We share information with:

  • Service Providers/Processors – cloud hosting, storage, security, analytics, customer support, email/SMS, payments/KYC (e.g., Stripe), shipping/fulfillment, auditing.
  • Transaction Counterparties – the other party in a sale (necessary shipping details, relevant order info).
  • Brand/Agency Partners (Creator Programs) – to evaluate or fulfill a brand deal or campaign you join; may include Creator contact info and storefront metrics/performance.
  • Advertising/Attribution Partners – for measurement and audience matching (see §3.8) subject to opt-outs.
  • Corporate Transactions – merger, acquisition, financing, or asset sale.
  • Legal, Safety & Rights – to comply with law, respond to lawful requests, enforce Terms, prevent harm, or protect FanVault, users, or the public.

We may share aggregated or de-identified insights (e.g., category performance, demand trends) with creators and partners.

6. Sensitive Personal Information

Some data (e.g., government ID, financial account data, precise geolocation if enabled, demographic data you choose to provide) may be considered Sensitive under certain laws. We limit use/disclosure of Sensitive data to what is necessary to provide the Service (e.g., KYC, payouts, fraud prevention) or as otherwise permitted by law or with your consent. Where required, you may limit certain processing (see §9).

7. Retention

We retain information as long as needed for the purposes in §3, and as required by law. Illustratively:

  • Account & Transaction Records: typically kept for 7 years for tax, accounting, and fraud/chargeback defense.
  • KYC/Identity Records: as required by our payment/KYC partners and applicable regulations.
  • Marketing & Analytics Data: for as long as useful for the purposes or until you opt out or delete your account, after which we may retain de-identified data.

Actual retention may vary based on legal, operational, and security needs.

8. Cookies, Pixels, and Similar Tech

We use cookies and SDKs to authenticate users, remember settings, track performance, and prevent fraud. We may also use them for analytics and advertising (see §3.8).

Controls: browser settings, in-product controls where available, and platform-specific ad settings. Blocking some cookies may break features (e.g., login, checkout).

9. Your Rights & Choices

Your rights depend on your location and the data we hold:

  • Access/Portability – request a copy of your data.
  • Correction – ask us to fix inaccurate data.
  • Deletion – request deletion (we may retain data we must keep by law or for legitimate interests like fraud prevention).
  • Opt-Out of Marketing – unsubscribe via emails or contact Support.
  • Opt-Out of "Sale/Share" and Cross-Context Behavioral Advertising (US State Laws, e.g., CA/CO/CT/VA/UT) – you may opt out of audience matching/advertising disclosure that those laws define as a "sale" or "share."
  • Limit Use of Sensitive Personal Information (CA) – you may request limits where applicable.
  • Preference Signals (GPC) – where required by law, we recognize browser Global Privacy Control signals as an opt-out of sale/share.

How to exercise: email info@fanvaultshop.com or use in-product controls where available. We may need to verify your request. You may use an authorized agent as permitted by law with proof of authorization. We will not discriminate against you for exercising lawful rights; however, certain features may require certain data to function.

10. Children's Privacy

The Service is for 18+. We do not knowingly collect personal information from anyone under 18. If we learn we collected such information, we will delete it and may terminate the account.

11. Security

We use technical and organizational measures appropriate to the risk (encryption in transit, access controls, monitoring). No system is 100% secure. You are responsible for safeguarding your credentials and keeping your account information current.

12. International Data Transfers

We may transfer, store, and process information in the United States and other countries. Where required, we rely on recognized transfer mechanisms (e.g., Standard Contractual Clauses) for cross-border transfers.

13. AI, Moderation, and Automated Decisions

We use automated systems and human review to: (a) detect prohibited content (e.g., nudity/graphic/explicit language), (b) fight fraud and abuse, (c) personalize recommendations, and (d) generate aggregated insights for creators and partners. We may use de-identified or aggregated data to train and improve these models. We do not use your personal messages or sensitive IDs to train models that are made publicly available to third parties without your permission.

14. Third-Party Links & Integrations

The Service may link to third-party sites or include integrations (payments, shipping, analytics, social). Their privacy practices are their own; review their policies.

15. California Privacy Notice (CCPA/CPRA)

Notice at Collection. We collect the categories of personal information described in §2 for the purposes in §3. We disclose PI to the categories of recipients in §5. We retain PI as described in §7.

Sale/Share of PI. We do not sell PI for money, but we may engage in advertising and audience matching that could be deemed a "sale" or "share." You can opt out (see §9).

Sensitive PI. We limit use/disclosure of Sensitive PI to necessary purposes (e.g., KYC/payouts) or as allowed by law or with consent. You may request limits (see §9).

Rights. California residents have rights to know/access, delete, correct, opt-out of sale/share, and limit use of Sensitive PI. We honor Global Privacy Control signals where required.

Shine the Light. California Civil Code §1798.83 permits users to request certain information regarding our disclosure of personal information to third parties for their direct marketing. Submit requests to info@fanvaultshop.com with "Shine the Light" in the subject.

16. Nevada, Colorado, Connecticut, Virginia, Utah & Other US State Laws

Residents of these states may have similar rights to access, delete, correct, and opt out of sale/targeted advertising. Use the methods in §9.

17. Changes to this Policy

We may update this Policy. Material changes will be notified via the Service or email and become effective when posted unless stated otherwise. Your continued use of the Service indicates acceptance of the updated Policy.
